On 6th September 2024 in the beautiful Bijela, Montenegro, CILC BESp project held a roundtable on Statement of Fact (SoF), an unknown legal instrument that is practiced by enforcement agents all-over the world for years but only recently became of interest to practitioners in Montenegro along with other Western Balkans countries. More than 49 countries have experience with it and now it was presented to the representatives of the Court, Academia, Ministry of Justice and the Chamber of Public Enforcement Officers.
BESp Lead Expert Mr. Jos Uitdehaag presented examples from his practice and other legal systems that recently introduced SoF, interesting videos and cases. Participants accepted with delight, both judges and law professors, as well as enforcement officers, the wide range of application that SoF could have and welcome its adoption. SoF is going to cover a big niche of missing certainty and burden of proof in daily life situations. It will also expand the responsibilities of PEOs and let society benefit from the services provided by them as delegated state power, contributing to the legal certainly and Rule of Law.
Earlier this year we held a Roundtable in Serbia, the topic was discussed during the Study Visit in Bulgaria and now representatives of North Macedonia also took part in this Roundtable, expressing interest to follow up with a similar event in Skopje.
BESp Project is responding to the requests of legal system in the Western Balkans supporting their efforts for the introduction of SoF.
